Data Controller

Data We Process

Articode processes personal data of contractors, clients, and their representatives, including members of governing bodies, proxies, and employees designated to perform agreements. Personal data may be provided in contracts, orders, contact forms, electronic and traditional correspondence, during domain registration processes, while creating and maintaining websites, and through cookies.

The scope of processed data may include first and last name, company name, position, identification data such as correspondence address, bank account number, email address, telephone number, IP address, data regarding the device and browser used, as well as data necessary for domain name registration, including domain subscriber data. In the case of website development services, Articode may also process data provided for publication on websites created at the client’s request. Providing personal data is voluntary; however, it may be necessary to conclude and perform a contract.

Services and Domain Registration

Articode provides services related to website development, digital solutions, and domain registration and maintenance. Within the scope of its services, domain names may be registered on behalf of the client. In justified cases, a domain may be technically registered under an Articode account while ensuring the client’s right to use the domain or to transfer it at a later stage. Depending on the nature of cooperation, Articode acts either as a data controller with respect to its own contractors’ data or as a data processor with respect to personal data entrusted by the client in connection with the operation of a website.

Legal Basis for Processing

Personal data is processed for the purpose of concluding and performing contracts pursuant to Article 6(1)(b) of the GDPR, for compliance with legal obligations arising from tax and accounting regulations pursuant to Article 6(1)(c) of the GDPR, for the establishment, exercise, or defense of legal claims pursuant to Article 6(1)(f) of the GDPR as a legitimate interest of the Controller, and for marketing purposes based on consent pursuant to Article 6(1)(a) of the GDPR.

Data Recipients

Recipients of personal data may include IT service providers, including hosting providers, cloud infrastructure providers, and domain registrars, technological subcontractors, accounting offices, legal and business advisors, and public authorities authorized to receive data under applicable law. As a rule, personal data is not transferred outside the European Union or the European Economic Area unless required by technical infrastructure and provided that appropriate safeguards compliant with the GDPR are ensured.

Data Security

Articode implements appropriate technical and organizational measures to ensure the protection of processed personal data, including safeguards against unauthorized access, loss, destruction, disclosure, or unauthorized modification of data. Entities cooperating with Articode are obliged to apply equivalent security standards.

Articode applies appropriate technical and organizational measures necessary to ensure confidentiality, integrity, accountability, and continuity of personal data processing of website users and contractors. In particular, we implement safeguards protecting data against unauthorized access, loss, destruction, disclosure, or unauthorized modification. Entities processing data on our behalf, including IT service providers, hosting providers, cloud infrastructure providers, and domain registrars, are required to apply equivalent security standards in compliance with applicable law, including the GDPR.

Data Retention

Personal data is retained for the duration of the cooperation and thereafter for a period of five full years following its termination, unless applicable law requires a longer retention period. Data of our contractors and their representatives is processed for the duration of the cooperation and subsequently retained for five full years after its termination, unless applicable law requires a longer archival period.

Your Rights

Data subjects have the right to access their data, obtain a copy of their data, rectify inaccurate data, request deletion of data, restrict processing, receive their data in a structured, commonly used, machine-readable format, withdraw consent where processing is based on consent, and lodge a complaint with the President of the Personal Data Protection Office (Poland).

Each data subject has the right to request information regarding the processing of their personal data. Upon request, we are obliged to provide a free copy of the processed data. The data subject may also request rectification of inaccurate data or completion of incomplete data. They are entitled to request deletion of data (“right to be forgotten”) provided there are no legally justified grounds for further processing. Where processing is based on consent, consent may be withdrawn at any time without affecting the lawfulness of processing carried out before its withdrawal. The data subject has the right to receive their data in a structured, commonly used, machine-readable format and to transmit that data to another controller. They also have the right to restrict processing in the event of a claim regarding the legal basis or accuracy of the data, until such claim is verified.
